These Terms of Service ("Terms") govern your use of TrackMySlabs ("the Platform"), operated by TRACKMYSLABS PTY LTD. By accessing or using TrackMySlabs, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.
1. Acceptance of Terms
By creating an account or using TrackMySlabs, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Description of Service
TrackMySlabs is a PSA (Professional Sports Authenticator) submission management platform designed for trading card stores. The Platform provides:
- PSA submission tracking and management
- Customer record management
- Automated PSA status updates via API integration
- Customer portal for submission tracking
- Email and SMS notifications for status changes
- Shopify customer synchronisation (optional)
3. User Accounts & Responsibilities
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorised access to your account
- Accept responsibility for all activities that occur under your account
You are responsible for ensuring that the customer data you enter into the Platform is accurate and that you have the necessary consent to store and process such data.
4. Subscription & Billing
TrackMySlabs offers a free trial period. Additional features or continued use may require a paid subscription. If applicable:
- Subscription fees are billed in advance on a recurring basis
- You authorise us to charge your payment method for all applicable fees
- Prices may change with reasonable notice
- No refunds are provided for partial subscription periods
- You may cancel your subscription at any time, effective at the end of the current billing period
Note for Australian consumers: Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other applicable consumer protection legislation in your jurisdiction. Where Australian Consumer Law applies, certain guarantees cannot be excluded.
5. Acceptable Use
You agree not to use the Platform to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Upload or transmit viruses, malware, or other harmful code
- Attempt to gain unauthorised access to the Platform or other users' accounts
- Interfere with the proper functioning of the Platform
- Use the Platform for any fraudulent or deceptive purposes
- Resell, redistribute, or sublicense access to the Platform without authorisation
5a. Uploaded Documents & Submission Files
Where you upload documents to the Platform — including PSA submission PDFs — the following applies:
- Opt-in only: Storage of imported PSA submission PDFs is disabled by default. You must explicitly enable this feature under Settings → Data & Improvements. You may disable it at any time.
- Purpose: Uploaded PDFs are stored solely to provide you with a record of the source document for each submission. They are not used for any other purpose.
- Access: Uploaded files are accessible only to your store account. We do not access, share, or process uploaded files except as necessary to store and retrieve them on your behalf.
- Deletion: Uploaded files are deleted when you delete the associated submission or when your account is closed, in accordance with our data retention policy.
- Your responsibility: You are responsible for ensuring that any document you upload does not contain personal information beyond what is necessary for the submission record, and that you have the right to upload it.
6. Intellectual Property
The Platform, including its original content, features, and functionality, is owned by TRACKMYSLABS PTY LTD and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any data you input into the Platform. By using the Platform, you grant us a limited licence to use, store, and process your data solely for the purpose of providing the services described herein.
7. Third-Party Services
The Platform integrates with third-party services including PSA, Shopify, and others. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or content of third-party services, or for any loss or damage arising from your use of such services.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The Platform will be uninterrupted, secure, or error-free
- The results obtained from using the Platform will be accurate or reliable
- Any defects in the Platform will be corrected
PSA submission status information is provided via PSA's API and we cannot guarantee its accuracy or timeliness. Always verify critical information directly with PSA.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKMYSLABS PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless TRACKMYSLABS PTY LTD and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another party.
11. Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Platform will immediately cease. You may request a copy of your data within 30 days of termination, after which we may delete your data in accordance with our data retention policies.
12. Misuse & Enforcement
To protect the integrity of the Platform and ensure fair access for all users, the following behaviours constitute misuse and are strictly prohibited:
- Account sharing: Sharing your account credentials with individuals at other stores, businesses, or organisations not covered by your subscription. Each subscription is issued to a single store.
- Multiple accounts: Creating more than one account or store for the same physical business in order to access multiple free trials, bypass usage limits, or circumvent any restriction applied to a prior account.
- Fee evasion: Any deliberate attempt to avoid paying subscription fees, including but not limited to: repeatedly creating new accounts to extend trial periods, initiating fraudulent chargebacks, or continuing to use the Platform after a subscription has lapsed without payment.
- Circumventing enforcement actions: Creating a new account, using a different email address, or accessing the Platform from a different IP address or device after your account has been suspended or terminated by us.
- Misrepresenting your identity or business: Providing false information during registration or billing in order to obtain access to the Platform or avoid enforcement.
Where we determine, at our sole discretion, that misuse has occurred or is suspected, we reserve the right to take any or all of the following actions without prior notice:
- Immediately suspend or permanently terminate the account(s) involved
- Block associated email addresses, IP addresses, or devices from accessing the Platform
- Pursue recovery of any outstanding fees or losses caused by the misuse
- Report the conduct to relevant authorities where it constitutes fraud or a breach of applicable law

13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
15. SMS Communications & Opt-Out
If you or your customers opt in to receive SMS notifications (e.g. submission status updates), the following applies:
- Message frequency varies based on submission activity
- Message and data rates may apply depending on your mobile carrier
- You can opt out of SMS notifications at any time by replying STOP to any message or by disabling SMS in your notification settings
- For help, reply HELP to any message or contact us at the address below
- SMS is provided via Twilio. By opting in, you acknowledge that your phone number will be shared with Twilio for delivery purposes
Store owners are responsible for obtaining appropriate consent from their customers before enabling SMS notifications on their behalf.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
